By using the eduksha.com or accounts. www.eduksha.com web site ("Service") you are agreeing to be bound by the following terms and conditions ("Terms of Service"). "The Service provider" is VA INFOTECH SOLUTIONS, incorporated under the Companies Act, 2013 with its registered office location 95-A, Pocket C-1, Kondli Gharoli,, Mayur Vihar Phase III, Delhi - 110096, India. The Service provider reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. Violation of any of the terms below will result in the termination of your Account. While service provider prohibits such conduct and Content on the Service, you understand and agree that the service provider cannot be responsible for the Content posted on the Service and you nonetheless may be exposed to such materials. BASIC TERMS
1. If you do not agree, you should decline this Agreement and immediately stop using the Service. Access to the Service is permitted only to those that fully agree with the terms and conditions of this Terms of Service agreement..

You agree that this Terms of Service Agreement and the relationship between the parties shall be exclusively governed by the laws of Republic of India without regard to conflict of law principles, or international conventions. The exclusive jurisdiction for any dispute resolution is the Allahabad High court in Uttar Pradesh state of India.

4. Your login may only be used by one person - a single login shared by multiple people is not permitted. You may create separate logins for as many people as your plan allows.
5. You are responsible for maintaining the security of your account and password. The service provider cannot and will not be liable for any loss or damage from your failure to comply with this security obligation
6. The Client undertakes to maintain full confidentiality over the Client's passwords related to the Service and the Client's Account. If the Client becomes aware of any unauthorized use of its password or of the Client's Account, the Client must notify the Service Provider immediately at info@eduksha.com
7. You are responsible for all Content posted and activity that occurs under your account (even when Content is posted by others who have accounts under your account.
8. You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
9. The Client undertakes not to harass, threaten, abuse or harm the Service Provider or other users of the Service in any way.
MEMBERSHIP ELIGIBILITY
Use of the eduksha Website is available only to persons who can form legally binding contracts under Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents etc. are not eligible to use the eduksha website. If you are a minor i.e. under the age of 18 years, you shall not register as a member of the eduksha and shall not transact or use eduksha website. As a minor if you wish to use or transact on eduksha, such use or transaction may be made by your legal guardian or parents who have registered as users of the eduksha. R D Excellent Services Pvt Ltd reserves the right to terminate your membership and refuse to provide you with access to the eduksha if it is brought to VA INFOTECH SOLUTIONS’s notice or if it is discovered that you are under the age of 18 years.
YOUR ACCOUNT AND REGISTRATION OBLIGATIONS
If You use the Website, You shall be responsible for maintaining the confidentiality of your User ID and Password and You shall be responsible for all activities that occur under your User ID and Password. You agree that if You provide any information that is untrue, inaccurate, not current or incomplete or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the this Terms of Use, We shall have the right to indefinitely suspend or terminate or block access of your membership on the Website and refuse to provide You with access to the Website.

Membership on the Website is free. There is no charge or fee for browsing on the Website. However some of the services on the website are chargeble.We reserve the right to charge fee and change its policies from time to time. In particular, we may at our sole discretion introduce new services and modify some or all of the existing services offered on the Website. In such an event we reserve, without notice to You, the right to introduce fees for the new services offered or amend/introduce fees for existing services, as the case may be. You shall indemnify and hold harmless VA INFOTECH SOLUTIONS, its owner, licensee, affiliates, subsidiaries, group companies (as applicable) and their respective officers, directors, agents, and employees, from any claim or demand, or actions including reasonable attorneys' fees, made by any third party or penalty imposed due to or arising out of Your breach of this Terms of Use, privacy Policy and other Policies, or Your violation of any law, rules or regulations or the rights of a third party.
This Agreement shall be governed by and interpreted and construed in accordance with the laws of India. The place of jurisdiction shall be exclusively in Delhi.
Unless otherwise specified, the material on the Website is presented solely for the purpose of sale in India. We make no representation that materials in the Website are appropriate or available for use in other locations/Countries other than India. Those who choose to access this site from other locations/Countries other than India do so on their own initiative and we are not responsible for supply of goods/refund for the goods ordered from other locations/Countries other than India, compliance with local laws, if and to the extent local laws are applicable.
If Eduksha comes across any difference in pricing resulting from typographic errors w.r.t pricing or product information, eduksha shall have the right to rectify the same or cancel the order(s) and refund monies, if any, collected from You within 10-15 business days of such corrective action taken. The mode of refund will be the same as at the time of placing the order. Cash on Delivery order refunds will be done by cheque.
We reserve the right to cancel any order at our sole discretion, under a situation where we are not able to meet the requirement of the order placed or order so placed/cancelled does not comply with the our policy or for any other reason. However, we will ensure that any communication of cancellation of an order, so cancelled, is intimated within appropriate time to the concerned person and any applicable refund will be made in reasonable time.
IN NO EVENT SHALL eduksha BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND IN CONNECTION WITH THIS AGREEMENT, EVEN IF eduksha HAS BEEN INFORMED IN ADVANCE OF THE POSSIBILITY OF SUCH DAMAGES.
